Zameriam sa preto iba nieko\u013eko mojich postrehov.<br>Za\u010dnem ot\u00e1zkou pr\u00e1va by\u0165 volen\u00fd a predklad\u00e1m k tomu nieko\u013eko ve\u013emi v\u00fdznamn\u00fdch s vo\u013ebami s\u00favisiacich t\u00e9m, na ktor\u00e9 je pod\u013ea m\u00f4jho n\u00e1zoru potrebn\u00e9 sa s\u00fastredi\u0165. K svojim pozorovaniam uv\u00e1dzam i pr\u00edslu\u0161n\u00e9 ustanovenia slovenskej \u00dastavy.<br>V prvom rade zd\u00f4raz\u0148ujem, \u017ee mojimi n\u00e1vrhmi nijako nechcem zasahova\u0165 do slobody ob\u010danov kandidova\u0165 vo vo\u013eb\u00e1ch v s\u00falade s platn\u00fdm pr\u00e1vom. Napriek tomu, \u017ee toto pr\u00e1vo maj\u00fa okrem ob\u010danov \u0161t\u00e1tu aj cudz\u00ed \u0161t\u00e1tni pr\u00edslu\u0161n\u00edci s obmedzen\u00edm na miestnu \u00farove\u0148, teda na vo\u013eby do org\u00e1nov samospr\u00e1v, budem hovori\u0165 najm\u00e4 o vo\u013eb\u00e1ch poslancov do parlamentu, u n\u00e1s v Slovenskej republike do N\u00e1rodnej rady. Krit\u00e9ri\u00e1 stanoven\u00e9 \u00dastavou a z\u00e1konom toti\u017e ako podmienku sta\u0165 sa poslancom N\u00e1rodnej rady nepredpokladaj\u00fa dosiahnutie vy\u0161\u0161ieho stup\u0148a vzdelania, alebo dokonca ani ot\u00e1zku potreby dostato\u010dn\u00e9ho stup\u0148a pr\u00e1vneho vedomia poslancov. A to aj pri plnom zachovan\u00ed slobodn\u00e9ho politick\u00e9ho postoja ka\u017ed\u00e9ho. Pod\u013ea \u010dl\u00e1nku 74 ods. 2 \u00dastavy, za poslanca mo\u017eno zvoli\u0165 ob\u010dana, ktor\u00fd m\u00e1 volebn\u00e9 pr\u00e1vo, dosiahol vek 21 rokov a m\u00e1 trval\u00fd pobyt na \u00fazem\u00ed Slovenskej republiky. Z\u00e1kon \u010d. 180\/2014 Z. z. v paragrafe 6 dop\u013a\u0148a podmienku sp\u00f4sobilosti osoby na pr\u00e1vne \u00fakony a vy\u017eaduje jej bez\u00fahonnos\u0165.<br>V tejto spojitosti rozhodne nemo\u017eno opomen\u00fa\u0165, \u017ee poslanci navrhuj\u00fa a prij\u00edmaj\u00fa z\u00e1kony, \u010dasto vo ve\u013ek\u00fdch mno\u017estv\u00e1ch, dokonca aj v s\u00favislosti s povinn\u00fdmi normami prij\u00edman\u00fdmi na \u00farovni Eur\u00f3pskej \u00fanie. T\u00e1to situ\u00e1cia vytv\u00e1ra na jednej strane siln\u00fd tlak na vedomosti poslancov, s\u0165a\u017euje mo\u017enos\u0165 d\u00f4kladn\u00e9ho pos\u00fadenia dopadov prij\u00edman\u00e9ho pr\u00e1va na ob\u010danov a vytv\u00e1ra \u010dasto zbyto\u010dne ve\u013ek\u00e9, alebo duplicitn\u00e9 za\u0165a\u017eenie \u0161t\u00e1tu a jeho v\u00fdkonnej administrat\u00edvy. Je len samozrejm\u00e9, \u017ee dopady na r\u00f4zne sf\u00e9ry v\u00fdroby, obchodu a slu\u017eieb s\u00fa \u010dasto vo vz\u00e1jomnom rozpore, \u010do musia poslanci tie\u017e rie\u0161i\u0165. Pod\u013ea m\u00f4jho presved\u010denia ch\u00fdba dlhodob\u00fd pl\u00e1n postupu tvorby potrebn\u00fdch z\u00e1konov, pl\u00e1n, ktor\u00fd by presahoval volebn\u00e9 obdobie jednej vl\u00e1dy. \u010cast\u00e9 zmeny a mno\u017estvo nov\u00fdch predpisov, ktor\u00e9 mus\u00ed Slovensk\u00e1 republika prij\u00edma\u0165 v d\u00f4sledku \u010dlenstva v Eur\u00f3pskej \u00fanii rozhodne nie s\u00fa v\u00fdlu\u010dne iba pr\u00ednosom a neprispievaj\u00fa k stabilite a preh\u013eadnosti pr\u00e1vneho prostredia \u0161t\u00e1tu. U\u017e len preto, \u017ee hospod\u00e1rska sila a produk\u010dn\u00e1 orient\u00e1cia jednotliv\u00fdch \u010dlensk\u00fdch \u0161t\u00e1tov je rozdielna a poslanci na to aktu\u00e1lne a v\u010das nie s\u00fa schopn\u00ed reagova\u0165. Napriek tomu, \u017ee maj\u00fa mo\u017enos\u0165 vyu\u017eitia servisu zo strany asistentov, \u010di do\u017eiadan\u00ed na odborn\u00e9 in\u0161tit\u00facie a skupiny osobitn\u00fdch legislat\u00edvcov, ktor\u00ed formuluj\u00fa samotn\u00e9 znenie pripravovan\u00fdch z\u00e1konov. Som presved\u010den\u00fd, \u017ee je nesporne nevyhnutne vyvin\u00fa\u0165 snahu aj o zaistenie kvalitnej\u0161ie pripraven\u00fdch kandid\u00e1tov pre v\u00fdkon ich mand\u00e1tu.<br>Vzh\u013eadom na pr\u00e1vo ka\u017ed\u00e9ho ob\u010dana uch\u00e1dza\u0165 sa vo vo\u013eb\u00e1ch o mand\u00e1t poslanca N\u00e1rodnej rady Slovenskej republiky, ktor\u00e9 je garantovan\u00e9 \u00dastavou, dovol\u00edm si upozorni\u0165, \u017ee \u010dl\u00e1nok 12 na\u0161ej \u00dastavy, ktor\u00fd hovor\u00ed, \u017ee \u013eudia s\u00fa slobodn\u00ed a rovn\u00ed v d\u00f4stojnosti i v pr\u00e1vach, \u017ee z\u00e1kladn\u00e9 pr\u00e1va a slobody s\u00fa neod\u0148ate\u013en\u00e9, nescudzite\u013en\u00e9, nepreml\u010date\u013en\u00e9 a nezru\u0161ite\u013en\u00e9. V \u010fal\u0161\u00edch \u010dl\u00e1nkoch sa uv\u00e1dza, \u017ee z\u00e1kladn\u00e9 pr\u00e1va a slobody sa zaru\u010duj\u00fa na \u00fazem\u00ed Slovenskej republiky v\u0161etk\u00fdm bez oh\u013eadu na pohlavie, rasu, farbu pleti, jazyk, vieru a n\u00e1bo\u017eenstvo, politick\u00e9, \u010di in\u00e9 zm\u00fd\u0161\u013eanie, n\u00e1rodn\u00fd alebo soci\u00e1lny p\u00f4vod, pr\u00edslu\u0161nos\u0165 k n\u00e1rodnosti alebo etnickej skupine, majetok, rod alebo in\u00e9 postavenie a \u017ee nikoho nemo\u017eno z t\u00fdchto d\u00f4vodov po\u0161kodzova\u0165, zv\u00fdhod\u0148ova\u0165 alebo znev\u00fdhod\u0148ova\u0165.<br>T\u00e1to \u00fastavn\u00e1 \u00faprava v kone\u010dnom d\u00f4sledku nijako nezakazuje stanovi\u0165 podmienku ist\u00e9ho stup\u0148a vzdelania kandid\u00e1tov na miesta poslancov do N\u00e1rodnej rady. V tomto smere d\u00e1vam do pozornosti slovn\u00e9 spojenie \u201e\u2026alebo in\u00e9 postavenie\u201c. Av\u0161ak ani to, i ke\u010f o tom mo\u017eno polemizova\u0165, nevylu\u010duje podmieni\u0165 kandidat\u00faru dosiahnut\u00edm ist\u00e9ho stup\u0148a vzdelania, \u010di v\u0161eobecn\u00fdch vedomost\u00ed o fungovan\u00ed \u0161t\u00e1tu.<br>Obdobne obsah \u010dl\u00e1nku 13, v ktorom sa uv\u00e1dza,<br>\u017ee medze z\u00e1kladn\u00fdch pr\u00e1v a slob\u00f4d mo\u017eno upravi\u0165 za podmienok ustanoven\u00fdch touto \u00dastavou len z\u00e1konom, \u017ee z\u00e1konn\u00e9 obmedzenia z\u00e1kladn\u00fdch pr\u00e1v a slob\u00f4d musia plati\u0165 rovnako pre v\u0161etky pr\u00edpady, ktor\u00e9 sp\u013a\u0148aj\u00fa ustanoven\u00e9 podmienky a \u017ee pri obmedzovan\u00ed z\u00e1kladn\u00fdch pr\u00e1v a slob\u00f4d sa mus\u00ed dba\u0165 na ich podstatu a zmysel a tak\u00e9to obmedzenia sa m\u00f4\u017eu pou\u017ei\u0165 len na ustanoven\u00fd cie\u013e,<br>je vlastne potvrden\u00edm tejto mo\u017enosti.<br>Mo\u017eno preto bez ak\u00fdchko\u013evek ob\u00e1v kon\u0161tatova\u0165, \u017ee t\u00e1to citovan\u00e1 formul\u00e1cia z\u00e1kona naopak umo\u017e\u0148uje stanovi\u0165 ist\u00e9 vzdelanostn\u00e9 minimum poslancom N\u00e1rodnej rady potrebn\u00e9 na v\u00fdkon mand\u00e1tu. Treba v tejto spojitosti zvl\u00e1\u0161\u0165 zd\u00f4razni\u0165, \u017ee moc v \u0161t\u00e1te je odvoden\u00e1 od ob\u010danov, ktor\u00ed vykon\u00e1vaj\u00fa \u0161t\u00e1tnu moc bu\u010f priamo, alebo pr\u00e1ve prostredn\u00edctvom svojich volen\u00fdch z\u00e1stupcov. To je ve\u013emi v\u00e1\u017ena a d\u00f4le\u017eit\u00e1 vec. Aj preto upozor\u0148ujem na t\u00fato akoby sprievodn\u00fa problematiku volieb.<br>Pritom nemus\u00ed \u00eds\u0165 o prijatie novej z\u00e1konnej podmienky dosiahnutia nejak\u00e9ho konkr\u00e9tneho stup\u0148a vzdelania kandid\u00e1tov. Posta\u010d\u00ed pravdepodobne efekt\u00edvne pripraven\u00e1 mo\u017enos\u0165 zavies\u0165 verejn\u00fd test ich znalost\u00ed z oblasti z\u00e1kladn\u00fdch pr\u00e1vnych predpisov, \u013eudsk\u00fdch pr\u00e1v a slob\u00f4d, delenia kompetenci\u00ed medzi org\u00e1ny \u0161t\u00e1tnej moci, znalosti z\u00e1kladn\u00fdch funkci\u00ed \u0161t\u00e1tu vo\u010di ob\u010danom, ako aj z\u00e1kladn\u00fd preh\u013ead o medzin\u00e1rodnej situ\u00e1cii. Mus\u00ed v\u0161ak by\u0165 splnen\u00e1 podmienka uveden\u00e1 v \u010dl\u00e1nku 30 ods. 4, \u017ee ob\u010dania maj\u00fa za rovnak\u00fdch podmienok pr\u00edstup k volen\u00fdm a in\u00fdm verejn\u00fdm funkci\u00e1m. Toto sa pridan\u00edm podmienky absolvovania navrhovan\u00e9ho verejn\u00e9ho testu z\u00e1kladn\u00fdch vedomost\u00ed poslanca N\u00e1rodnej rady rozhodne splni\u0165 d\u00e1. S t\u00fdm s\u00favis\u00ed tie\u017e \u010fal\u0161ia sprievodn\u00e1 ot\u00e1zka, a to potreba skvalitnenia volieb pomocou fundovan\u00e9ho v\u0161eobecn\u00e9ho vzdel\u00e1vania mladej gener\u00e1cie na \u0161kol\u00e1ch. Ide o zabezpe\u010denie vzdelania \u0161irokej popul\u00e1cie. Vzdelan\u00fd \u010dlovek je rozh\u013eaden\u00fd a nenech\u00e1 sa manipulova\u0165 r\u00f4znymi z\u00e1ujmov\u00fdmi skupinami, ako to pravidelne pri vo\u013eb\u00e1ch o\u010dividne pozorujeme.<br>\u010eal\u0161ou ot\u00e1zkou, ktor\u00fa vn\u00edmam ako mimoriadne d\u00f4le\u017eit\u00fa je akt\u00edvna \u00fa\u010das\u0165 pozorovate\u013eov na priebehu volieb zo zahrani\u010dia, resp. uznanie OBSE ako hlavn\u00e9ho org\u00e1nu dozoru nad priebehom a v\u00fdsledkami volieb v mnoh\u00fdch \u0161t\u00e1toch Eur\u00f3py a sveta. Pod\u013ea platn\u00fdch dokumentov sa zd\u00e1, \u017ee v\u0161etko je ako m\u00e1 by\u0165. Ale na podklade negat\u00edvnych sk\u00fasenost\u00ed mo\u017eno kon\u0161tatova\u0165, \u017ee a\u017e pr\u00edli\u0161 \u010dasto je OBSE politicky zneu\u017e\u00edvan\u00e1 na neuznanie v\u00fdsledkov volieb v suver\u00e9nnych \u0161t\u00e1toch, ktor\u00e9 s\u00fa v danom obdob\u00ed pova\u017eovan\u00e9 kolekt\u00edvnym Z\u00e1padom za nedemokratick\u00e9 alebo inak neprijate\u013en\u00e9. Zasahovanie do volieb v suver\u00e9nnych \u0161t\u00e1toch by malo by\u0165 pr\u00edsnej\u0161ie regulovan\u00e9 aj v medzin\u00e1rodnom pr\u00e1ve. In\u00fdmi slovami, je nutn\u00e9 sa s\u00fastredi\u0165 a dohodn\u00fa\u0165 na tom, \u017ee ka\u017ed\u00fd \u0161t\u00e1t, ktor\u00fd funguje na z\u00e1klade princ\u00edpov pr\u00e1vneho \u0161t\u00e1tu, nesmie by\u0165 negat\u00edvne posudzovan\u00fd iba pre v\u00fdsledok slobodn\u00fdch volieb nevyhovuj\u00faci Z\u00e1padu. Naopak, rozhodnutie ob\u010danov mus\u00ed by\u0165 v plnom rozsahu re\u0161pektovan\u00e9. Nad suver\u00e9nnym \u0161t\u00e1tom u\u017e neexistuje \u017eiadna in\u00e1 in\u0161titucion\u00e1lna autorita. Medzin\u00e1rodn\u00e9 in\u0161tit\u00facie so suverenitou \u0161t\u00e1tu nemaj\u00fa v\u00f4bec ni\u010d spolo\u010dn\u00e9. \u0160t\u00e1ty nie s\u00fa medzin\u00e1rodn\u00fdm organiz\u00e1ci\u00e1m podriaden\u00e9. \u0160t\u00e1ty s\u00fa sami dobrovo\u013en\u00fdmi a slobodn\u00fdmi tvorcami medzin\u00e1rodn\u00fdch organiz\u00e1ci\u00ed na plnenie konkr\u00e9tnych spolo\u010dn\u00fdch cie\u013eov.<br>V\u0161etci vieme, \u017ee ve\u013ek\u00e1 v\u00e4\u010d\u0161ina t\u00fdch najv\u00fdraznej\u0161\u00edch medzin\u00e1rodn\u00fdch organiz\u00e1ci\u00ed je u\u017e dlhodobo pod siln\u00fdm vplyvom USA a kolekt\u00edvneho Z\u00e1padu. Ten sleduje vlastn\u00e9 politick\u00e9, ekonomick\u00e9, ale najm\u00e4 egoistick\u00e9 mocensk\u00e9 ciele. Mo\u017eno dokonca s lakonick\u00fdm k\u013eudom poveda\u0165, \u017ee mnoh\u00e9 medzin\u00e1rodn\u00e9 organiz\u00e1cie boli vytvoren\u00e9 pr\u00e1ve a iba s motiv\u00e1ciou kontroly dominantn\u00fdch mocnost\u00ed nad ostatn\u00fdmi \u0161t\u00e1tmi. Tak\u00fdto pr\u00edstup je v zmysle Charty OSN nedovolen\u00fd a nesmie, v\u00f4bec by\u0165 akceptovan\u00fd. V tejto s\u00favislosti spomeniem dobre zn\u00e1mu prax USA, ke\u010f ich pr\u00edslu\u0161n\u00e9 \u0161t\u00e1tne org\u00e1ny, najm\u00e4 ministerstvo zahrani\u010dn\u00fdch vec\u00ed, za v\u00fddatnej pomoci politick\u00fdch n\u00e1tlakov\u00fdch mimovl\u00e1dnych organiz\u00e1ci\u00ed, korup\u010dne podriaden\u00fdch m\u00e9di\u00ed a opozi\u010dn\u00fdch s\u00edl v sledovan\u00fdch \u0161t\u00e1toch, vyhotovovali spr\u00e1vy o stave \u013eudsk\u00fdch pr\u00e1v v jednotliv\u00fdch \u0161t\u00e1toch sveta. Tak\u00e9to spr\u00e1vy boli n\u00e1strojom politick\u00e9ho tlaku a prakticky nikdy nevyjadrovali skuto\u010dn\u00fa situ\u00e1ciu v posudzovan\u00fdch \u0161t\u00e1toch. Okrem toho i\u0161lo o hrub\u00e9 zasahovanie do vn\u00fatorn\u00fdch z\u00e1le\u017eitost\u00ed in\u00fdch suver\u00e9nnych \u0161t\u00e1tov. Pritom si nikto nedovolil kritizova\u0165 situ\u00e1ciu v USA. Aj tu platilo zn\u00e1me v\u00fdsme\u0161n\u00e9 heslo \u201ezlodej kri\u010d\u00ed, chy\u0165te zlodeja\u201c. Priliehavej\u0161ia pritom je e\u0161te modifik\u00e1cia tohto hesla \u201ezlodej kri\u010d\u00ed, chy\u0165te-\u00fadajn\u00e9ho-zlodeja\u201c. USA nie s\u00fa pre n\u00e1s nijak\u00fdm vzorom demokracie. Je to nepochybn\u00fd v\u00fdsmech voli\u010dom, ob\u010danom, ktor\u00fdm sa pred vo\u013ebami s\u013eubuj\u00fa \u010dasto nesplnite\u013en\u00e9 ciele a po vo\u013eb\u00e1ch je v\u0161etko po starom. Nov\u00e9 vojny, nov\u00e9 dane poplatky a povinnosti. Takto sa v USA vyvinul syst\u00e9m iba dvoch hlavn\u00fdch politick\u00fdch str\u00e1n, ktor\u00e9 si medzi sebou delia a dohaduj\u00fa obsadzovanie mocensk\u00fdch poz\u00edci\u00ed a v z\u00e1kulisnom pozad\u00ed sa vz\u00e1jomne podporuj\u00fa. Dokonca ide rafinovan\u00fd mechanizmus dosadzovania vlastn\u00fdch det\u00ed a \u010fal\u0161\u00edch rodinn\u00fdch pr\u00edslu\u0161n\u00edkov na svoje miesta, ke\u010f star\u0161\u00ed poslanci a sen\u00e1tori odch\u00e1dzaj\u00fa do d\u00f4chodku.<br>V pr\u00edpade posudzovania z\u00e1kladn\u00fdch princ\u00edpov v\u0161eobecn\u00fdch volieb pova\u017eujem za d\u00f4le\u017eit\u00e9 pouk\u00e1za\u0165 na osobitn\u00fd v\u00fdznam zabr\u00e1nenia \u00fa\u010dasti voli\u010dov zo zahrani\u010dia prostredn\u00edctvom internetu. Jedn\u00fdm zo zisten\u00ed upozor\u0148uj\u00facich na rizik\u00e1 internetu je aj spr\u00e1va Eur\u00f3pskej komisie pre demokraciu prostredn\u00edctvom pr\u00e1va, viac zn\u00e1mej ako \u201eBen\u00e1tska komisia\u201c, z j\u00fana roku 2019, ktor\u00e1 okrem mnoh\u00fdch in\u00fdch z\u00e1verov kon\u0161tatovala v bode 13, \u017ee ve\u013ek\u00fdm s\u013eubom internetu bolo jeho fungovanie nez\u00e1visle od existuj\u00facich monopolov v oblasti komunik\u00e1cie, ale v skuto\u010dnosti maj\u00fa ve\u013ek\u00e9 nadn\u00e1rodn\u00e9 korpor\u00e1cie glob\u00e1lnu kontrolu nad tokom inform\u00e1ci\u00ed, a s\u00fa preto v postaven\u00ed, v ktorom m\u00f4\u017eu tvarova\u0165 politick\u00fa diskusiu a formova\u0165 n\u00e1zory.
